Credigo Digital Private Limited (“our”, “us”, “we”, “Company” or “Credigo”) is a company incorporated in India under the provisions of the Companies Act, 2013, having its registered office at Plot 13, Sector 18, Electronic City, Phase IV, Udyog Vihar, Gurugram – 122015, Haryana, India. [Credigo, through its Website (as defined below) and App (as defined below) runs an employee financial wellness platform that enables employees to withdraw the salary earned amount on credit, at any time, extended by Lending Partner (as defined below), subject to agreed-upon transaction fees. Furthermore, Credigo provide other financial wellness service, directly or through its Financial Wellness Service Partners, including financial coaching, insurance,  and financial investments.]

The purpose of this privacy policy (“Policy”) is to give you information on how Credigo collects, stores, uses, discloses, transfers and processes your Information when: (a) you use our websites including the Website, software applications, mobile applications including the App or platform(s) of any of our Lending Partner; or (b) you avail any Services (as defined below) which we may offer to you either directly through our Websites and/ or the App or through a merchant or partner platform; including the steps we take to protect your Information. By accessing the Website, the App and/ or using the Services directly or indirectly, you agree that you have read and understood, and agree to be bound by this Policy.

While accessing the Website, the App and/ or using the Services directly or indirectly, in the past, present or future, you may be required to provide your specific and prior consent for us to collect, use, store, disclose or otherwise process your Information. You further acknowledge and accept that your specific consent provided on our Website, the App, and/ or during usage of the Services shall also be applicable to your Information submitted to us, directly or indirectly, in the past.

We may revise this Policy as well as update our Services from time to time and it is strongly recommended for you to return to this page periodically to review the most current version of this Policy which is amended by us from time to time.

1. Definitions

  • 1.1.App” means the software applications or mobile applications including the Credigo application.
  • 1.2.Applicable Law(s)” means all laws, ordinances, statutes including the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000, rules, orders, decrees, judgments, injunctions, licenses, permits, approvals, authorizations, consents, waivers, privileges, agreements, and regulations of any governmental authority having jurisdiction over the relevant matter as such, and as may be amended, modified, enacted or revoked from time-to-time hereafter.
  • 1.3.Information” means Personal Data, non-personal data, and cookies.
  • 1.4.IP” means the Internet Protocol.
  • 1.5.Lending Partner” shall mean various partner banks and financial institution of Credigo, who are registered with RBI to provide financial products and services.
  • 1.6.Personal Data” means any data about an individual who is identified by or in relation to such data.
  • 1.7.RBI” shall mean the Reserve Bank of India.
  • 1.8.Services” shall mean products, features, services, technologies, software that are being offered by Credigo on the Website and/ or the App.
  • 1.9.URL” means the Uniform Resource Locator.
  • 1.10.Website” refers to www.credigo.in and additional portals/ micro/ mini/ mobile sites that link to the main back-end to create a distributed presence to fulfil the needs and functional requirements of all segments of customers. It is clarified that the term ‘Website’ includes all pages that are sub-domains or are associated with or exist within each website which is hosted by Credigo.
  • 1.11. Financial Wellness Service Partners refer to providers of services like financial coaching, insurance, and financial investments.
  • 1.12. API partners refer to providers of API’s like SMS, PAN verification, Aadhaar verification, Bank account verification, Face matching, Credit Bureau Check, etc

2. Collection of Information

These are the categories of Information that we collect from you:

  • 2.1. Personal Data:
    • 2.1.1. User data: We collect the data you and/or your employer provides to us when you create or update your account on our Website and/ or the App. This includes your name, phone number, email address, permanent account number (PAN), date of birth, pin code, nature of employment, official employment email address and name of employer, and monthly income. We may require you to share further data at a later date to confirm the veracity of your data or under any additional features added to the Website and/ or App. We also collect the data provided by you, including emails or chats, during correspondence with us. We collect your data when you subscribe, search or avail any Services including while reporting problems/ grievances in relation to the Services or the Website and/ or the App.
    • 2.1.2. Financial and KYC Data: The Lending Partners, API partners and Financial wellness service partners, and we collect your data when you access and opt to avail our Services including the loan/ credit facility provided by our Lending Partner and facilitated by us. This data includes your photograph, Aadhar number, PAN, parents’ names, bank account number and its IFSC, proof of address (which may include your electricity bill, rental/ lease agreement, gas bill, passport, driver’s license or voter’s identity card, or any other document the Website and/ or the App may be able to record).
    • 2.1.3. Location Data: We may collect your device location for verifying your address for the know your customer (KYC) check and completing the onboarding process. We may access your location when the Website and/ or App is running in the background.
    • 2.1.4. Camera Data: We use your webcam and/ or phone’s camera to capture your selfie for verification, scanning the QR codes, and for uploading documents as per the instructions of our Lending Partners, API partners and Financial wellness service partners in accordance with the Applicable Laws.
    • 2.1.5. Credit Bureau Checks: With your consent, we conduct inquiries with credit bureaus, regulatory authorities, or any relevant third parties to verify your credit history or gather any other necessary data.
    • 2.1.6. Device data: When you install the App, we store your user data with unique identifiers tied to the device you are using. We fetch data from the device when you download and install the App by explicitly seeking permission from you to get the required data from the device. We also collect your log data (via the domain server through which the user accesses the App search queries, IP address, caches, date, etc.) to improvise the App’s functionality. In addition to the above, we also track and collect the data related to the performance of the App and other diagnostic data for identifying and resolving any technical glitches that may be identified from such data and also for improving the overall functionality of the App.
    • 2.1.7. Installed Application Data: We collect and transmit a list of specific installed applications’ metadata which includes the application name, package name, installed time, updated time, version name, and version code of each installed application on your device. This data may be collected even when the App is not in use or is closed.
    • 2.1.8. Other Information: We may from time to time, ask for additional data, which we require to provide the services. Any data collected on the app, is being stored with us , our Lending Partners, API partners and Financial wellness service partners, as per governing laws.
    • 2.2. Non-Personal data:
      • 2.2.1. This is the data that does not identify a specific individual by itself or in combination with other data. We may gather certain demographic data about you including gender and consumer preference based on how you navigate the Website and/ or the App.
      • 2.2.2. We may also gather data relating to human resource management through an attendance tracking system using geolocation or selfie-based feature to mark attendance with regularisation and leave requests with a track of attendance records.
      • 2.2.3. This data may be compiled and analysed on both a personal and an aggregated basis. This data may include the website’s URL that you just came from, which URL you next go to, what browser you are using, and your anonymised IP address.
      • 2.2.4. We may use your non-personal data to analyse request usage patterns and behaviours to enhance our Website and/ or the App, Services, or use it for our marketing purposes. We reserve the right to use and disclose non-personal data to any third party at our discretion.
    • 2.3. Cookies:
      • 2.3.1. A cookie is a small piece of data sent from a webpage and stored in a user’s web browser, mobile phone, or other device while the user is browsing that webpage. The Website cannot function without these cookies. 3. Storage of Information

  • 3.1. Please note that we do not store all the Information provided by you, except basic personal information such as your name, contact number, transactional details, and address details to fulfil our legal obligations, resolve disputes, and enforce our agreements, all under Applicable Laws. We indicate the mandatory and optional fields whenever possible. You have the choice not to provide certain Information by opting out of specific services or features on the Website and/ or the App.
  • 3.2. While browsing some sections of the Website and/ or the App do not require registration, certain activities such as availing loans from our Lending Partners do require registration and providing the requisite details. Information collected as part of our outsourcing services for our Lending Partners is collected and stored based on their instructions and shared with them as and when required.
  • 3.3. We do not collect any biometric data from you for any of our Services. If any of our representatives request such data, please refrain from providing it and notify our Data Protection Officer/ Grievance Redressal Officer support@credigo.in.
  • 3.4. Your Information will be processed locally in India, where our approved third-party service providers operate, as permitted by Applicable Laws, the transaction related data i.e., data pertaining to our Services will be stored in India. Our databases and Information are stored on secure servers with appropriate firewalls. Credigo uses industry standard physical, technical, and administrative security measures to safeguard all Information, confidential and secure. We conduct periodic reviews of our security measures pertaining to our Information collection and storage to guard against unauthorized access to systems.
  • 3.5. Given the nature of internet transactions, Credigo does not take any responsibility for the transmission of Information including user data shared by you. Any transmission of Information on the internet is done at your risk and Credigo shall not be responsible for the circumvention of the privacy settings or security measures either by you or any third party.

4. Purposes of Collection and Use of Information

  • 4.1. We collect Information from you to facilitate lending and non-lending services, and we ensure that the Information is used solely for the intended purposes outlined below:
    • 4.1.1. Establishing identity: We collect Information to establish and verify your identity accurately.
    • 4.1.2. Facilitating KYC: We use the Information to facilitate the KYC process as per the instructions of our Lending Partners.
    • 4.1.3. Troubleshooting and administration: The Information is utilized to troubleshoot issues, monitor, improve, and administer our Website and/ or the App. We analyze the usage patterns of the Website and/ or the App, diagnose service or technical problems, and maintain security. We also collect Information (about your device) to provide automatic updates and additional security so that your account is not used on other people’s devices. We further collect other identifiable Information including your transaction history on the Website and/ or the App when you set up an account with us.
    • 4.1.4. Service provision: We use the Information to provide Services including facilitating loans. Credigo may also access, gather, and disclose Information to its Lending Partners, API Partners and Financial Wellness Service Partners. When sharing this Information, Credigo will ensure secure transmission and require all recipients to adhere to confidentiality, fidelity, and secrecy obligations by signing appropriate agreements. Additionally, Credigo may share Information with financial and non-financial companies, government agencies, courts, legal investigators, or other non-affiliated third parties when requested by you or your authorized representative, or when legally required or permitted under Applicable Law.
    • 4.1.5. Customization: The collected Information enables us to design and offer customized Services in collaboration with our third-party partners.
    • 4.1.6. Communication: We use the Information to send communications, notifications, and information about requested Services, and to process queries and applications made on the Website and/ or the App.
    • 4.1.7. Consumer interest and satisfaction: We measure consumer interest and satisfaction in our Services, helping us manage our relationship with you.
    • 4.1.8. Marketing and promotion: The Information is used for marketing and promotional purposes, including sending promotional SMS, emails, and WhatsApp messages to inform you about online and offline offers, products, services, and updates.
    • 4.1.9. Data analysis: We conduct data analysis to improve the Services.
    • 4.1.10. Compliance with Applicable Laws and regulations: We utilize Information to comply with Applicable Laws.
    • 4.1.11. Dispute resolution and fraud prevention: The Information is used to resolve disputes, detect, and protect against suspicious or illegal activity, fraud, and other criminal activities including prevention of corporate espionage, maintenance of confidentiality of trade secrets, intellectual property, classified information or provision of any service or benefit sought by you.
    • 4.1.12. Customized experience and terms enforcement: We customize your experience on our Website and/ or the App and enforce our terms and conditions effectively.
    • 4.1.13. Emergencies: The Information may be used to take measures to provide you medical treatment or health services during an epidemic, outbreak of diseases, or any other threat to public health. We may also use the Information for responding to a medical emergency involving a threat to the life or immediate threat to your health or any other individual. Information may also be used for taking measures to ensure safety of, or provide assistance or services to, any individual during any disaster, or any breakdown of public order.

  • 5.1. We will only share your Information with our third parties, including regulated financial partners and vendors, to facilitate the Services. Here is how we disclose and share your Information:
    • 5.1.1. Facilitation of services: We may share your Information with financial service providers, banks, non-banking financial companies (NBFCs), our Lending Partners, API Partners and Financial Wellness Service Partners to facilitate loans, credit facilities, or any other services.
    • 5.1.2. Data analysis: We share your Information with third-party partners to conduct data analysis, enabling us to better serve you and improve our services.
    • 5.1.3. Enforcement and protection: In certain cases, we may disclose your Information to enforce our terms of use or as part of corporate divestitures, and mergers, or to protect the rights, property, or safety of our users, ourselves, or others. This may involve sharing Information with other companies and organizations to prevent fraud and reduce credit risks.
    • 5.1.4. Tracking user interaction: We may share Information with technology partners to track user interactions on our Website and/ or the App on behalf of Credigo.
    • 5.1.5. Business transactions: If our assets merge with or are acquired by another business entity, or if there is a reorganization, amalgamation, or restructuring of our business, we may share your Information with that entity. The receiving business entity will be bound by this Policy regarding your Information.
    • 5.1.6. Third-party technology providers: We may disclose your Information to third-party technology or data source providers.
    • 5.1.7. Confidentiality agreement: We share your Information with third parties under a confidentiality agreement, ensuring that they only use the Information for the purposes outlined in this Policy.
    • 5.1.8. Completeness of Information: We shall ensure that the Information shared with third parties are complete, accurate and consistent with the Information provided by you.
    • 5.1.9. Regulatory compliance: We may disclose your KYC journey or related Information to relevant regulatory authorities as part of our statutory audit process.
    • 5.1.10. Governmental and judicial authorities: If required by Applicable Law, we may share your Information with governmental authorities, quasi-governmental authorities, judicial authorities, and quasi-judicial authorities. This will be done in compliance with legal obligations under Applicable Laws. By accepting this Policy, you consent to the disclosure of your Information for such regulatory purposes.
  • 5.2. We may disclose or share non-personal, anonymous or aggregated data with third parties including usage statistics of our Services, or IP addresses. Aggregated non-personal data is the data recorded about users and collected into groups so that it no longer reflects or references an individually identifiable user. These third parties may collect data when users visit our Services. These third parties may use this aggregated data about your visits to this and other websites in order to provide advertisements on the other websites and other forms of media about goods and services of interest to you.

Through this Policy, we hereby seek your consent to transfer your Information to our approved third-party service providers under designated contracts for the purposes as may be communicated to you from time to time. Should your Information move outside India, we will ensure to comply with the provisions of Applicable Laws and will also ensure that our third-party processors shall also comply with the same level of data protection as are applicable in India under Applicable Laws.

6. Security Measures to Protect Information Under our Control

This includes encryption of transmitted data over the internet. We also require our registered third-party service providers to implement measures to protect your Information.
  • 6.2. Our Website and/ or the App have robust security measures in place to safeguard against loss, misuse, and alteration of Information under our control. This allows us to defend against a wide range of security threats, from basic vulnerabilities to sophisticated attacks. From time to time, we review our security procedures in order to consider appropriate new technology and methods.
  • 6.3. To ensure the security and privacy of your Information, we take the following measures:

    • 6.3.5. Compliance with regulations: We adhere to Applicable Laws and regulations, ensuring compliance with data protection requirements.
    • 6.3.6. Data transfers: We comply with legal frameworks relating to the transfer of data, as mandated by Applicable Laws.
    • 6.3.7. Complaint resolution: In the event of formal written complaints, we promptly respond and collaborate with the appropriate regulatory authorities, including local data protection authorities, to resolve any data transfer-related concerns that cannot be resolved directly with you.
  • 6.4. However, as with any information travelling over the internet and kept in servers, we cannot guarantee absolute security. Additionally, we use commercially reasonable computer security safeguards to protect our databases and servers against risks of loss, unauthorized access, destruction, misuse, modification, or inadvertent or improper disclosure of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store Information. Security risks, however, cannot be completely eliminated and we therefore cannot guarantee complete security. If you send us an email, you should know that email is not necessarily secured against interception. Therefore, if your communication will include sensitive personal information like your bank account, charge card, or social security number, and you prefer not to transmit it electronically, please contact us by postal mail or telephone rather than email. We do not send emails asking for a user’s username and password or its windows username and password or any other username or password.

Consequently, we cannot ensure or warrant the security of any Information you transmit to us and do so at your own risk.

Our third-party service providers follow best practices such as separation of environments, segregation of duties, and role-based access control. We do not permit unauthorized access to your non-public personal contacts or financial transaction SMS data by any third party, except our trusted Lending Partners about lending services. Please note that our Website and/ or the App may also include links to other websites. We are not responsible for the privacy practices or content of such linked websites. This Policy only addresses the collection, disclosure, and use of data by us. The linked websites may have different data collection practices and policies, and we do not have control over their policies or any liability with them.

7. Marketing

In relation to the Services provided by us or by third parties with whom we share your Information as per this Policy, you may receive marketing communications from Credigo or third parties, by messages, or email or through other digital modes, on the Website and the App or such other platforms including social media platforms, or on such third party platforms website and apps including social media platforms, if you have provided us your Information. We may market our own Services including the products and services being offered by third parties using such communication. The provision of such marketing activities shall be in accordance with Applicable Laws. For the marketing activities done by us, we execute contracts with our merchants, service providers, banks, or other third parties. You are entitled to opt out from receiving such marketing communication by either clicking on opt-out link (if available) or un-subscribe by clicking the link provided (if available) or by writing to us at support@credigo.in.

8. Your Rights

  • 8.1. Data retention and data deletion: The retention period of your Information is determined by the duration necessary to provide our Services. We may also retain and use basic personal information such as your name, contact number, transactional details, and address details to fulfil our legal obligations, resolve disputes, and enforce our agreements, all under Applicable Laws. If you no longer want to use our Services and want your account/ Information to be deleted, you may contact us at support@credigo.in to request that your user account be deleted. Your user account and all your Information will be deleted within a period 30 days from the date on which you request deletion thereof or in case there is any active contract then the expiry/termination of the contract plus 30 days. Please note that after deletion, you will no longer be able to use our Services.
  • 8.2. Access of Information: You may request Credigo to share a summary of Information that Credigo has collected from you including the processing activities undertaken in relation to such Information, and the identities of the third parties with whom such Information is shared along with description of such Information. The details requested by you will be processed and delivered to you within a period of 30 days from the date on which you request such Information. Credigo is not liable to share any information to you relating to the identities of the third parties with whom such Information is shared along with description of such Information if such Information is obtained by third parties in accordance with Applicable Laws for the purposes of prevention/ detection/ investigation of offences or cyber incidents, or for prosecution or punishment of offences.
  • 8.3. Rectification of inaccurate or incomplete Information: You can change, correct, alter, modify, update your Information at any time by e-mailing us at support@credigo.in. However, please note that in the event you alter, update or delete your account Information, we cannot ensure the continuity or quality of the Services being provided to you. We may permit or deny modification of any Information, to the extent such Information is required by it order to be compliant with and observe Applicable Laws. You have the right to ask us to correct inaccurate or incomplete Information concerning you.
  • 8.4. Data Portability: Data portability is the ability to obtain some of your Information in a format you can move from one service provider to another. Depending on the context, you may also be entitled to request copies of Information that you have provided to us in a structured, commonly used, and machine-readable format and/ or request us to transmit this Information to another service provider (where technically feasible).
  • 8.5. Withdrawing consent and restriction of collecting data: Where you have provided your consent to the collecting of your Information by Credigo, you (either yourself or through any one of your representatives, as may be appointed by you under Applicable Law) may withdraw your consent at any time by sending a communication to Credigo at support@credigo.in specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal. However, please note that in the event you withdraw your consent, we cannot ensure the continuity or quality of the Services being provided to you. All requests will be addressed no later than 48 business hours from the date such a request for withdrawing the consent is made, after which Credigo and its affiliates shall cease process the Information for which the consent is withdrawn, unless such processing without your consent is required or authorized under Applicable Laws.
  • 8.6. Data destruction protocols: Upon completion of the retention period for each category of Information as described above, we shall delete or destroy, to the extent technically possible, Information in our possession or control, or render the Information into anonymised data, so that it no longer constitutes personal data.

9. Your Duties

  • 9.1. You shall comply with the provisions of all Applicable Laws while exercising your rights set out in this Policy.
  • 9.2. You shall ensure not to impersonate another person while providing your Personal Data to us.
  • 9.3. You shall ensure not to suppress any material information while providing your Information for any document, unique identifier, proof of identity or proof of address issued by the government or any of its instrumentalities.
  • 9.4. You shall ensure not to register a false or frivolous grievance or complaint with Credigo or the Data Protection Board of India.
  • 9.5. You shall furnish only such Information as is verifiably authentic, while exercising the right to correction or erasure under this Policy.

10. Children’s Privacy

Our Services are not directed to children, and we do not knowingly solicit or collect Information from persons under the age of 18 (Eighteen). If we find out that a child has given us Information, we will take steps to delete that Information and terminate the relevant account on our Website and/ or the App.

11. Communication from Us

12. Nomination

You have a right to nominate or appoint a representative or agent to act on your behalf, who shall, in the event of your death or incapacity, exercise your rights with respect to your Information.

13. Amendments

This Policy is subject to change from time to time. If we make changes to this Policy, we will post the revised Policy and update the ‘Last Updated’ date at the top of this Policy. If you disagree with the revised Policy, you may delete your user account.

15. Governing Law and Jurisdiction

This Policy shall be governed in all respects by the laws of India. To the fullest extent permitted by Applicable Laws, you hereby expressly agree that any proceeding arising out of or relating to this Policy shall be instituted in courts in Gurugram, Haryana (India).
